Appeal from the United States District Court for the Eastern District of North Carolina, at Raleigh.

Raymond Ray Johnson, Appellant Pro Se.

E.D.N.C.

AFFIRMED.

Before RUSSELL and MURNAGHAN, Circuit Judges, and CHAPMAN, Senior Circuit Judge.

PER CURIAM:

OPINION

1

Appellant appeals from the district court's order denying relief on his 42 U.S.C. § 1983 (1988) complaint. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court.* Johnson v. Heineman, No. CA-93-155 (E.D.N.C. May 27, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED

We deny Appellant's Motion for Appointment of Counsel. Whisenant v. Yuam, 739 F.2d 160 (4th Cir. 1984)
